Legal challenge to tobacco ad ban is snuffed out

A legal challenge brought against a display ban on tobacco products in Scottish shops by Imperial Tobacco Limited has been dismissed by the Court of Session in Edinburgh..

Imperial had gone to court in order to challenge the competence of the measure in addition to a forthcoming ban on the sale of cigarettes from vending machines.

In its case the firm had argued both measures fell outwith the legislative competence of the Scottish Parliament but Lord Bracadale judged that neither challenge was “well founded”.
