Customers left in the dark by Apple over disappearing text messages when switching to rival operating systems is to take the technology giant to court.

A feature called iMessage enables Apple owners to convert SMS messages to data to avoid eating into their monthly allowance but after switching to the likes of Android, where iMessage is not available, the system breaks down – preventing the receipt of new messages.

The long-running issue has forced Apple to develop a web tool for people can manually remove themselves from Apple’s iMessage database, something which previously required a call to customer services, but this is too little, too late for many.

Amongst them is Adrienne Moore of California who is seeking class-action status and unspecified damages after falling victim to the glitch when switching from an iPhone 4 to a Samsung Galaxy S5.

US District Judge Lucy Koh has cleared the way for this to proceed after deciding that Apple did have questions to answer over disruptions to her wireless service contract.

A court case is now on the cards over the issue but Apple has yet to comment.
