Royal prank call radio station attempts legal block of investigation

2Day FM, the radio station which broadcast the infamous prank call to the hospital where Kate Middleton was admitted during her pregnancy, has raised a legal action which challenges the communication watchdog's right to investigate whether the station broke the law.

Two weeks ago the Federal court ruled that the Australian Communication and Media Authority had the authority to investigate the incident. SDay FM has now lodged an appeal.

The Southern Cross Media-owned station went to court in June after a preliminary investigation by ACMA found that the crank call segment represented the use of a broadcasting service in the commission of an offence.

The station is also facing a legal action raised by participant DJ Mel Greig who claims the station failed to provide her with a safe place of work.

The ACMA has the power to conclude that the radio station may have breached the broadcasting licence condition that states a licensee must not use its broadcasting service in the commission of an offence.

A prior hearing on November 7 upheld the right of the ACMA to investigate.

The note of appeal was lodged at court on Tuesday. The case calls on February 15.
