Apple has lost its appeal in a British court over a ruling that its rival Samsung's Galaxy tablet did not copy the iPad - and must now publish an advert saying that.

Samsung Galaxy: Not as cool as the iPad.Official

The world's two leading smartphone makers are fighting over patents, both for smartphones and for tablets, in courts around the world. Apple had a big success in California when a $1 billion ruling went its way.

But in London The Court of Appeal today upheld a judgment that despite some similarities, Samsung did not infringe Apple's design, in part because its products were "not as cool" as the iPad.

The U.S. company was instructed to run ads saying the Korean company did not copy the iPad, both on its website and in selected newspapers.

Judge Kitchin said the notices must be in a font size no smaller than Ariel 14.

But he also ruled - and the Court of Appeal upheld his decision - that Apple should advertise the fact that Samsung doesn't infringe, and do it on its website, in newspapers and magazines.

So what is Apple going to say in the ad ? It's not clear whether the advert will have to be approved by Samsung.

The Guardian offered an early suggestion from Forrester Research's Harley Manning:

"I don't know whether Apple can get away with what I'm about to suggest, but here's the ad I'd love to see them run: Official Government Verdict: The iPad Is Cool And The Samsung Galaxy Is Not Cool."

Do Drum readers have any suggestions as to what the Apple ad should say ? Post your thoughts in comments.
