Only judicial review would allow Nike to overturn ASA decision to ban Wayne Rooney sponsored tweets
Nike has lost its appeal to overturn an ASA ruling to ban its promoted Tweets by Wayne Rooney. An independent reviewer upheld the original decision which saw the drive become the first Twitter ads to fall foul of the ASA. This means, that the only way Nike can now challenge the ban is to seek a judicial review.
The ruling in June by the ASA claimed that tweets made by the Manchester United footballer, as part of Nike’s Make it Count campaign, one of which read; "My resolution – to start the year as a champion, and finish it as a champion….#makeitcount gonike.me/makeitcount" was not a clearly market piece of marketing communications.
Similar tweets were also sent by fellow England player Jack Wilshere as part of the AKQA devised campaign. Nike had argued that few would have been misled by the series of tweets.
