Samsung seeks Dutch ban on iPhones and iPads

Samsung has escalated the increasingly bitter intellectual property dispute between it and Apple by seeking to obtain a banning order on the sale of iPhones and iPads in the Netherlands.

The legal move follows Apple’s successful EU wide injunction against the sale of three models of Samsung’s Galaxy smartphone.

That suit centred on claims that Samsung had copied Apple’s design but the latest claim is that Apple’s iPhone3GS, iPhone4 and iPad’s 1&2 all make use of Samsung’s patented 3G technology.

If Samsing are successful in their action Apple will be banned from importing, trading or selling these devices within the Netherlands – with the later possibility of all models being pulled from stores.

Apple’s lawyers have set up a hearing between both firms to discuss the licensing issue with the expectation that Apple will agree to negotiate license fees for the use of the technology.
