Sim loses love tribunal

Alistair Sim, the former managing director of Love Creative, has lost his case against the Manchester agency after claiming he was unfairly dismissed.

Sim took Love to an employment tribunal in September but both parties have been awaiting the outcome after a decision was delayed by tribunal members.

The dispute goes back to November 2008 when it was originally thought Sim had resigned from the agency after being convicted of assault.

But the matter came to a head after Sim revoked his resignation and Love's board instigated disciplinary procedures.

At the tribunal, Sim claimed he had been given assurances that he could return to one of Love's businesses - Toy or Make - once the furore surrounding his conviction had subsided.

But this was denied by Love's creative director, Dave Palmer, who said there was no agreement and Sim had resigned “unequivocally” when his conviction came to light.

The tribunal has now returned its decision that Love did not dismiss Sim unlawfully and the agency said it is "pleased" with the verdict.

In a statement, the agency said: "LOVE are pleased with the verdict of not guilty for unlawfully dismissing Alistair Sim. The judgement was reached by three independent employment specialists at an industrial tribunal in Manchester.

"During 2009 LOVE have got on with what they do best, great creative work for globally renowned clients such as Sony Playstation, Umbro and Dr Martens. The agency has also quietly got its house in order and as a result have a strong management team and a great bunch of talented people working there. This diligent team have weathered the wider global climate and come out on top.

"This result gives LOVE a positive kick start to 2010."
