Sunday Herald could face legal action over website comments

The Sunday Herald could face legal action after comments were posted on to its website, linking NATO’s General Secretary George Robertson to Dunblane killer Thomas Hamilton.

The comments were posted and sat on the website for a number of weeks until the Sunday Herald’s editor Andrew Jaspan was alerted to them by Roberston. Jaspan removed the comments immediately and apologised to Robertson for allowing them to get on to the site. However, Robertson has now contacted the Sunday Herald to ask for a written apology and has not ruled out taking legal action.

Jaspan refused to comment on the details of the case, but did say: “The comments were removed as soon as I was made aware of them and I regret that they made it on to the site in the first place.”

If the case goes to court then it could highlight the current frailties of internet policing, which is often non-existent and leaves many publishers open to legal action.
